Chittapur Procession: High Court Important Notice, Big Setback for RSS

Chittapur Procession: The court has adjourned the hearing regarding the RSS procession in Chittapur on November 2. The Kalaburagi High Court Division Bench, which heard the application filed seeking permission for the RSS procession in Chittapur today (October 30), has directed to hold another peace meeting.

The court has directed to hold a peace meeting at the Advocate General’s office in Bengaluru on November 5 at 3 pm and adjourned the hearing to November 7. Thus, the RSS, which planned to hold a procession in Chittapur on November 2, has been setback.

Justice M.G.S. Kamal told the government and the petitioners that a peace meeting was scheduled for November 5 with the petitioners and their lawyers, and that this should be a guideline for how the solution should be in the event of such an incident.

The hearing was held to review the outcome of the peace meeting (held on October 28) with the RSS and other organizations, which ended without a consensus.

State Government – Advocate General (AG) Shashikiran Shetty: -Submitted that the mandated peace meeting had failed to reach an amicable solution. – Stated that the petitioner (RSS Convenor, Ashok Patil) did not personally appear at the peace meeting as directed by the court, and thereby had “virtually evaded notice.”

– Contended that the petitioner’s conduct (including filing an application to implead the Union of India) suggested the intent was “only politics,” not cooperation. – Argued that the State was trying to find a solution but the petitioner was not cooperating. – Requested a final opportunity for a meeting to be held.

RSS Petitioner – Senior Advocate Aruna Shyam: -Submitted that “responsible members” of the organization were present at the October 28 meeting and provided all necessary details about the march. – Argued that the petitioner, Ashok Patil, could not attend due to a bonafide reason (a death in the family).

– Insisted that holding the route march is a fundamental right and that the State should accommodate the RSS’s request first and find other dates for the rival organizations. – Suggested that the petitioner could join the next meeting via video conference.

High Court’s Observation & Order:          

Justice MGS Kamal:- Noted that the effort to resolve the matter through mediation (the peace meeting) had failed. – Orally remarked that the petitioner was specifically directed to attend and “mediation is always the best possible way to resolve such issues.”

– Directed a Second Meeting: Ordered the RSS Convenor and district authorities to hold a second meeting on November 5 at the Advocate General’s office, with Senior Counsel from both sides present to guide the modalities.

– Next Hearing Date: Adjourned the case to November 7, when the outcome of the second meeting will be reviewed to make a final decision.
