RSS Procession In Chittapur: High Court made important instructions

RSS procession In Chittapur: The Kalaburagi High Court bench, which heard the issue of permission for the RSS procession in Chittapur in the district, has instructed the petitioners to file a new application with the procession route to the District Collector.

The High Court has directed the government to consider the petitioners’ request. Thus, it has issued an important order. It has also adjourned the hearing to 2.30 pm on October 24.

The RSS procession was to be held in Chittapur on Sunday. But Tahsildar Nagaiah Hiremath had issued an order denying permission. Hence, RSS workers had started a legal fight. Similarly, RSS Kalaburagi district leader Ashok Patil had filed a writ petition in the Kalaburagi High Court bench, challenging the DC’s action.

An urgent hearing was held in the bench of Justice MGS Kamal. Senior advocate Arun Shyam argued for the petitioner. The judge questioned who should be given permission according to the law. We had informed the police to provide security. We had informed the police about this on October 13 itself. We had filed an application with the Executive Magistrate on October 17. Arun Shyam argued that permission was denied for the procession on Saturday.

Is permission required for a group to march without protesting or shouting slogans? The High Court questioned whether members of a large family should get permission for a march to raise awareness about the environment and under which law permission should be obtained.

Advocate Vadiraj Kadlur, representing the petitioner, replied that there is no clear law for such matters. Today, another organization has staged a protest. Bhim Army and Dalit Panthers have also sought permission for the protest. The government’s argument was that permission was not given keeping in mind law and order.

At this time, the High Court has directed the High Court to allocate separate time for both the RSS and Bhim Army organizations. The petitioners have agreed to hold the RSS procession on November 2. 250 peaceful processions have been held across the state. The High Court, which recorded the petitioner’s statement that there was no disturbance of peace anywhere, has directed the petitioner to file a fresh application.
