Husband gives triple talaq to wife for not giving him Bullet bike as dowry
Maharashtra: In a shocking incident, a man from Thane, Maharashtra, has been booked for allegedly giving his wife “triple talaq,” despite the practice being legally prohibited in India since 2019.
The case has once again brought attention to the legal battle surrounding the ban on this controversial practice, which is deemed an offense under Indian law. According to police sources, the victim, a 25-year-old woman from Bhivandi, was married to Rashid, a resident of Sultanpur district in Uttar Pradesh, a few months ago.
After the wedding, she moved to her husband’s home, but soon began facing physical and mental abuse at the hands of her husband and in-laws. During the wedding, the woman’s family had promised to give a Bullet bike as part of the dowry, but the bike was never provided.
As a result, the husband and his family began torturing the woman. Last month, the abuse escalated, and she was verbally insulted and physically assaulted. Following this, her husband pronounced “triple talaq,” officially declaring the marriage over.
The victim returned to her parental home and, in distress, filed a police complaint against her husband and his family, accusing them of harassment, dowry-related abuse, and giving “triple talaq.” She also stated that she had provided gold as part of the dowry during the marriage, but the promised Bullet bike was never delivered, which led to the talaq.
Following the woman’s complaint, a case has been filed under various sections of the Indian Penal Code against the husband and his family. The practice of “triple talaq,” which allows a husband to instantly divorce his wife by uttering the word “talaq” three times, was declared illegal and unconstitutional by the Indian government in 2019.
Despite this, incidents of “triple talaq” continue to surface. Senior Police Inspector Ashok Ratnaparkhi stated that an investigation into the case is underway, and legal action will be taken against the accused husband. He emphasized that the practice of triple talaq is legally prohibited and those indulging in it will face the consequences.
Rising Cases of Triple Talaq in Bhivandi:
Bhivandi, a town in Maharashtra, has seen a worrying rise in cases of triple talaq. So far, 35 such cases have been registered in the area, even after the law was passed banning the practice. This suggests that while the law is in place, instances of triple talaq continue to occur, often in defiance of the legal provisions.
In a similar recent case, a man reportedly sent a “triple talaq” message to his wife via WhatsApp, writing the divorce declaration in three different languages: Urdu, Arabic, and English. This highlights the continued misuse of the practice despite the government’s efforts to safeguard the rights of Muslim women.
Government’s Efforts to Protect Women’s Rights:
The central government introduced the law banning triple talaq in 2019 to protect the rights of Muslim women, recognizing the practice as harmful and discriminatory. The law provides for a jail term of up to three years for those found guilty of pronouncing triple talaq. Despite these efforts, incidents like this one indicate that much more needs to be done to create awareness and enforce the law effectively.
As the investigation continues, this case serves as a reminder of the ongoing struggle to protect women from regressive practices, and the need for stricter enforcement of laws to ensure their safety and rights.
