New Birth and Death Certificate Rules Approved With Stricter Registration Process and Online Application Guide

India has introduced stricter rules for delayed birth and death registrations while retaining online application facilities making document verification stronger and official record management more transparent nationwide.

The process for obtaining birth and death certificates in India has undergone significant changes following the approval of the Registration of Births and Deaths Amendment Bill 2026 by Parliament. The revised law introduces stricter procedures for delayed registrations while continuing to encourage digital applications through official online portals. The government says the changes are aimed at improving the accuracy of public records, preventing fraudulent certificates and strengthening document verification across the country.

Birth and death certificates are among the most important identity related documents used for education, healthcare, inheritance, passports, pensions and several government services. Because of their legal importance, authorities believe that delayed registrations should undergo greater scrutiny to ensure that the information entered into official records is genuine and properly verified.

One of the biggest changes under the amended law concerns registrations that are filed long after the actual birth or death has occurred. Earlier, delayed registrations beyond one year could generally be approved by an Executive Magistrate. Under the new legal framework, approvals will now depend on how much time has passed since the event, introducing a more structured verification system.

If the registration is being completed more than one year after the birth or death but within two years, applicants will now have to obtain approval from the District Magistrate, the Sub Divisional Magistrate or another Executive Magistrate authorized by the government. Before granting permission, the concerned authority will verify supporting documents and confirm the authenticity of the information submitted by the applicant.

The rules become even stricter for registrations delayed by more than two years. In such cases, administrative approval alone will no longer be sufficient. Instead, registration can only proceed after receiving an order from a Judicial Magistrate First Class. This additional judicial review is intended to reduce the possibility of forged records entering the official registration system and to ensure that every delayed application undergoes careful legal examination.

Officials believe the revised approval structure will strengthen public confidence in birth and death records while making it more difficult for fraudulent certificates to be created through false declarations or fabricated documents. The government has stated that accurate civil registration is essential for maintaining reliable demographic data and ensuring transparency in public administration.

Despite the tighter rules for delayed cases, the online application process for certificates continues to remain simple for citizens registering births and deaths within the normal time period. Applicants can submit requests through the official Civil Registration System portal or the website of their respective municipal corporation or local authority, depending on their place of residence.

For a birth certificate, applicants must first create a user account through the Citizen Login or General Public Signup option on the official registration portal. After logging into the system, users can select the online birth registration service and begin entering the required information.

The application requires details such as the child’s name, date of birth, place of birth and information about both parents. Applicants must also upload supporting documents, including the birth report or discharge summary issued by the hospital and valid identity documents of the parents. Once all required information has been entered and verified, the application can be submitted online.

After submission, the system generates an application reference number that should be saved for future tracking. Once the local registration authority completes document verification and approves the application, the digitally signed birth certificate becomes available for download through the portal. This digital certificate serves as an official legal document and can be used for multiple government and educational purposes.

The process for obtaining a death certificate follows a similar procedure. Applicants need to register or log into the official portal before selecting the death registration service. Information such as the date, time and place of death, along with details of the applicant, must be entered accurately.

Supporting documents, including the hospital issued death summary or medical certificate confirming the death, along with valid identity documents of both the deceased and the applicant, must be uploaded during the application process. After successfully submitting the form, applicants receive a reference number that can be used to monitor the progress of their request.

Following verification by the concerned authority, the digitally signed death certificate becomes available for download through the online portal. This certificate is required for legal procedures including property transfer, insurance claims, pension settlements, bank account closures and other official formalities.

Government officials have encouraged citizens to register births and deaths as early as possible to avoid additional verification requirements introduced under the amended law. Timely registration not only simplifies the application process but also ensures that official records remain accurate and up to date.

Experts believe the revised legislation represents a major step toward strengthening India’s civil registration system. By combining stricter verification for delayed registrations with convenient online application facilities, the government aims to improve transparency, reduce document fraud and build a more reliable database of vital records across the country.
