Vinay Kulkarni convicted in Yogesh Gowda murder case,  MLA  post at risk

 

Bengaluru,  : In a major political and legal development, a special court for elected representatives has convicted Congress MLA Vinay Kulkarni in the sensational Yogesh Gowda Murder Case. Soon after the verdict was pronounced, officials of the Central Bureau of Investigation (CBI) took Kulkarni into custody from the courtroom and shifted him to Parappana Agrahara Central Prison.

The court is scheduled to hear arguments on the quantum of sentence on April 16, following which the punishment will be announced. With charges of murder and criminal conspiracy proven, Kulkarni faces a minimum sentence of life imprisonment, which could extend to the death penalty depending on the court’s final ruling.

MLA  membership under threat
The conviction has placed Kulkarni’s  MLA position  under serious threat. As per law, any legislator sentenced to imprisonment of two years or more stands disqualified from holding office. Given the gravity of charges, legal experts indicate that a sentence beyond two years is highly likely, which could lead to his immediate disqualification as MLA.

With the conviction now in place, Kulkarni’s immediate legal recourse lies in approaching the Karnataka High Court. He can file an appeal challenging the conviction and seek bail. Additionally, he may request a stay on the conviction. Only if a stay is granted can he retain his MLA position; otherwise, both imprisonment and disqualification would follow.

Won election despite restrictions
Notably, Kulkarni had contested and won the 2023 Assembly elections from Dharwad despite restrictions on entering his constituency. The court had earlier barred him from visiting the constituency due to his involvement in the case. Yet, he managed to defeat BJP leader Amrut Desai and secure a seat in the Assembly, making his political journey highly unusual.

Case background
The case dates back to June 2016, when Yogesh Gowda was brutally murdered inside a gym in Dharwad. The incident had triggered widespread outrage and evolved into a high-profile political case.

Following demands from the victim’s family, the probe was handed over to the CBI in 2019. During the investigation, Kulkarni was named as Accused No. 15 in the chargesheet, intensifying political controversy.

With sentencing due soon, the case is set to have far-reaching implications on Karnataka politics and the Congress party’s leadership dynamics in the state.
