Meanwhile, Swiggy has clarified its moonlight policy that ‘no employee has any objection to accept another assignment during his weekend, after the day’s work period is over’. Before accepting another company’s moonlight offer, internal approval should be obtained. Swigi employees are not allowed to work in the company office of another company. Accepting an assignment from another company should not be used as an excuse to reduce the productivity of the employee, Swigi clarified.

Is moonlight illegal? Is it correct?

In India’s current economic situation and inflation, there is a demand for companies to treat employees more humanely. IT entrepreneur Mohandas Pai has a similar stance. It is not right to call moonlighting as cheating. Any employee is contracted with the company to work during a certain period of the day.

What does the law say?

Factory workers and government employees who have to strictly follow labor laws and government employment rules are not allowed to moonlight according to law. But such restrictive laws do not (mostly) apply to IT employees like Infosys Wipro, who do administrative and supervisory work.

But the terms and conditions of the contract entered into with the employees by the particular company while giving the job are applicable to the employees. There is a clause in it that there is no opportunity to work in another company, and if the employee moonlights after agreeing to it, it will be considered illegal.

Will the moonlight stop?

The discussion about moonlighting in India has now started because an employee of the IT industry was working in another company. But this is the order that has prevailed since the beginning. The illegal-legal debate has been going on for a long time. Teachers working in schools and colleges do homework in the evening or early morning.

Moonlight existed in Indian society from the beginning in many ways, such as government employees engaging in (financially oriented) intellectual activities like writing and translation, clerks working in CA offices writing accounts for other companies, government doctors running private clinics.

If he is not able to earn as much as he wants from his current job, what is wrong if he does another job during the spare time and increases his earnings? Isn’t this better than bribery or begging? Those who are in favor of Moonlight argue that how many companies are paying OT for working more than the stipulated period.
