Dharwad MLA Vinay Kulkarni disqualified after conviction in Yogesh Gowda murder case

Dharwad, : Vinay Kulkarni has been officially disqualified from the Karnataka Legislative Assembly following his conviction in the Yogesh Gowda murder case. The order was issued by the Karnataka Assembly Secretariat, confirming the termination of his membership from the Dharwad constituency.
According to the official notification, the disqualification takes effect from April 15, the date on which the court pronounced him guilty in the high-profile murder case. The order was signed and enforced by Assembly Secretary Vishalakshi.
Disqualification under constitutional provisions
The action has been taken under Article 191(1)(e) of the Constitution of India and provisions of the Representation of the People Act, 1951, specifically Section 8, which mandates disqualification of elected representatives upon conviction in criminal cases.
As per the law, any legislator convicted by a court loses their membership from the date of conviction unless the conviction is stayed by a higher court.
Six-year disqualification period
The order further clarifies that unless a competent court stays the conviction, Kulkarni will remain disqualified not only during the period of imprisonment but also for six years after his release. This effectively sidelines him from electoral politics for a significant duration.
Political impact
The development has triggered intense political activity in Dharwad, with parties expected to recalibrate their strategies in the constituency. The disqualification opens up the seat, potentially leading to a by-election if legal relief is not obtained.
Kulkarni’s conviction and subsequent disqualification mark a significant moment in Karnataka politics, reinforcing the legal provisions aimed at maintaining accountability among elected representatives.
