An equal education system is needed for all the children who have adopted the state curriculum. So, the education department has come up with the board exam. It should not be understood as the type of examination conducted for 10th and 12th class students. Children have been preparing for many days. However, the students get confused as the exam dates are changed again and again. No rules under section 145 of the Karnataka Education Act need to be published in the notification.

The state government’s move to conduct board exams is against the Right to Compulsory Education Act. Under section 30 of the RTE Act, minors are not allowed to appear for board exams. Under section 22 of the Karnataka Education Act, the government has published a notification to conduct this examination without following any rule. The right of parents of students has been curtailed by the government’s move. Advocate A Velan and KV Dhananjaya argued for the defendants.

Under the Karnataka Education Act, the state education department had issued two circulars on October 6 and 9, 2023 to conduct board level examinations for classes 5, 8, 9 and 11. The RUPSA organization had approached the court questioning this. The single member bench which heard this petition quashed the circulars of the education department and issued an order.

However, the government appealed to the two-judge bench. The two-judge bench that heard the appeal stayed the order of the single-judge bench. It was later elevated to the Supreme Court. The Supreme Court, which stayed the order of the two-member bench of the High Court, ordered an urgent hearing of the appeal filed by the government before the two-member bench and passed an appropriate order.
