The case of rape and murder of a student from Dharmasthala village in Belthangadi taluk of Dakshina Kannada district has taken a new turn.

Soujanya Murder Case: Twelve years ago, the case of rape and murder of a student from Dharmasthala village in Belthangadi taluk of Dakshina Kannada district has taken a new turn. The High Court has issued a notice to the state government and the CBI regarding the petition filed by the deceased’s father seeking to order a re-investigation.

After hearing the arguments of the petitioner’s counsel for some time, the respondent in the petition, Notice issued to State Home Department Secretary, State Director General of Police, CID ADGP, Crime and Technical Services Division ADGP, Dakshina Kannada Superintendent of Police, CID Deputy Superintendent of Police, Belthangadi Police Station Officer and CBI.

A criminal appeal filed by the CBI challenging the judgment of the trial court acquitting Santosh Rao from the pending appeal case is pending before the Divisional Bench. Counsel for the petitioner pleaded that this petition should be fixed for hearing before the Division Bench along with the appeal.

Having considered the same, the bench directed the Registry to seek permission from the Chief Justice to schedule the application before the appropriate Divisional Bench as per the roster. Santhosh Rao, who was acquitted in the case, has also been made a defendant in the case. The petitioner, the prosecution (investigators) have failed to prove the role of the accused in this criminal act and the charges against him.

It is clear that the investigation was not done properly. As it will be clear that the entire investigation has not been conducted fairly, they have requested that a re-investigation should be ordered.

On 9th August 2012, Saujanya was kidnapped, gang-raped and brutally murdered. Santhosh Rao was arrested by Belthangadi police station. Later, the investigation of the case was transferred to CID and later to CBI. The CBI completed the investigation and filed a charge sheet against Santosh Rao. The Sessions Court acquitted Santosh Rao on June 16, 2023 on the ground that there was no sufficient evidence.
