
Bengaluru: In a significant ruling on divorce and maintenance, the Karnataka High Court has held that a wife earning more than her husband cannot automatically claim alimony simply because she is a woman. The court observed that maintenance should be decided only after carefully assessing the financial condition of both spouses instead of relying on gender based assumptions.
The case reached the High Court after a man challenged an interim order passed by a family court directing him to pay his former wife Rs 20,000 every month as maintenance. The couple had married in 2024 but separated within a few months because of marital differences. Following the separation, the wife approached the family court seeking financial support.
During the hearing before the High Court, the husband argued that his former wife earned nearly Rs 1 lakh every month, while his own monthly salary was Rs 60,646. He contended that she was financially independent and did not require maintenance. On the other hand, the wife submitted that she needed financial assistance to repay loans taken for the marriage.
After examining the facts, the bench of Justice Chillakur Sumalatha set aside the interim maintenance order passed by the family court. The High Court stated that courts should not presume every wife is automatically entitled to maintenance from her husband. Instead, they must consider the earning capacity, financial stability and responsibilities of both parties before issuing such orders.
The court further observed that maintenance should generally be granted only when the wife has no reasonable means to support herself. If she is financially secure, earns more than her husband and does not have additional responsibilities such as caring for dependent children, maintenance cannot be awarded merely on the basis of gender.
The judgment is expected to serve as an important reference in future matrimonial disputes by reinforcing that decisions on alimony should be based on financial realities rather than traditional assumptions about the roles of husbands and wives.
