Hijab Verdict: Supreme Court split verdict, dismisses Muslim students appeal

Karnataka Hijab Verdict: Justices Hemant Gupta and Sudhanshu Dhulia delivered a divided verdict. The Supreme Court of India gave a historic verdict on the Hijab Controversy, which was eagerly awaited by the whole world on Thursday. Most of the lawyers who argued for and against Hijab were present in the court. Justices Hemant Gupta and Sudhanshu Dhulia delivered a divided verdict. Currently, Justice Hemant Gupta is reading the verdict. He dismissed the appeal petition of the Muslim students.

Justice Hemant Gupta dismissed the petitions challenging the Karnataka High Court order and upheld the hijab ban in educational institutions in the state, while Justice Dhulia said, “wearing hijab is a matter of choice”.

The matter has been referred to a larger bench.  A bench of Justices Hemant Gupta and Sudhanshu Dhulia had reserved its judgement on the pleas against the Karnataka High Court judgement refusing to lift the ban on hijab on September 22 after hearing arguments for 10 days Hijab Controversy.

The judgement on these pleas has been on the cards this week as Justice Gupta, who is heading the bench, is due to retire on Sunday. During the arguments in the top court, lawyers appearing for the petitioners had insisted that preventing the Muslim girls from wearing the hijab to the classroom will jeopardise their education as they might stop attending classes.
