Karnataka Assembly Revokes Vinay Kulkarni Disqualification After High Court Relief

The Karnataka Assembly Secretariat has officially withdrawn the disqualification order against Dharwad MLA Vinay Kulkarni, clearing the way for him to resume his responsibilities as a legislator. The development follows significant relief granted by the Karnataka High Court, which stayed the conviction against Kulkarni and granted him bail in the Yogish Gowda murder case.

The latest decision marks a major turning point in Kulkarni’s political career. With the Assembly Secretariat issuing a fresh notification cancelling the earlier disqualification order, the legal barriers preventing him from functioning as an MLA have now been removed. The move allows the Congress leader to return to legislative duties while the criminal proceedings continue through the judicial process.

The High Court order has generated considerable political attention across Karnataka, especially in Dharwad and neighboring Belagavi districts. A division bench of the Karnataka High Court comprising Justice Mohammad Nawaz and Justice G Basavaraja recently examined appeals filed by the convicted individuals. After hearing the matter, the court suspended the conviction and sentence awarded to the accused while granting them bail pending further legal proceedings.

The court directed each of the accused to execute a bond of five lakh rupees along with the required sureties before being released on bail. The suspension of the conviction became particularly significant because it directly affected Kulkarni’s eligibility to continue as a legislator.

Legal experts point out that when a conviction is stayed by a higher court, the immediate consequences arising from that conviction, including legislative disqualification, can also be reconsidered depending on the applicable legal provisions. Those who received bail include Chandrashekar Indi, popularly known as Chandu Mama, Dinesh, Ashwath, Sunil, Nazir Ahmed, Shanawaz, Nutan, Harshith and Channakeshav Tingarikar. Their convictions have also been stayed until the appeals are finally decided.

The High Court’s decision does not amount to an acquittal. Instead, it temporarily suspends the conviction and sentence while the appeal is heard in detail. The criminal case will continue before the court, and the final outcome will depend on the evidence and legal arguments presented during the appeal process.

Political observers believe the Assembly Secretariat’s decision carries considerable importance because it restores the representation of the Dharwad constituency in the legislature through its elected member. Kulkarni can now attend Assembly sessions, participate in debates and carry out constituency related responsibilities without the earlier legal restrictions.

The Congress party welcomed the development, with local leaders describing it as an opportunity for Kulkarni to continue serving the people of Dharwad. Party workers expressed confidence that the legal process would eventually establish the facts of the case through due judicial procedure.

Supporters organized celebrations across parts of Dharwad after the announcement. Firecrackers were burst in several places, while Congress workers distributed sweets and congratulated one another following the court order and the Assembly Secretariat’s subsequent action. The case has remained politically sensitive because it involves prominent figures from both the Congress and the BJP. Over the years, court proceedings have attracted widespread public attention, with every major legal development closely watched by political parties and observers across Karnataka.

While the legal proceedings continue independently, the Assembly Secretariat’s decision ensures that the constituency does not remain without its elected representative due to the earlier disqualification order.
