Karnataka: Dead cockroach in jamun bowl: Hotel ordered to pay Rs 55,000

Bengaluru: A dead cockroach was discovered afloat in a bowl of jamun he had ordered at a city store, where he was sentenced to Rs 55,000 for serving him adulterated food. The restaurant owner filed an appeal against the decision, but the state consumer court upheld it, arguing that the customer must be compensated for the failures.

KM Rajanna, a 57-year-old advocate and Gandhinagar resident, and his friend attended the Kamath Hotel in Gandhinagar on September 15, 2016. They ordered dosas and jamuns. Things allegedly got worse when the advocate began taking photos and videos of the dish. According to the lawyer, the waiter attempted to steal his cellphone and cause confusion.

The advocate started off at the local police station and then the district consumer forum in Shantinagar with a complaint against Kamath Hotel for providing adulterated or poisonous food. Despite a court notice being sent to the hotel representatives on September 24, the restaurant remained ex-parte.

Representatives of Kamath Hotels approached the Basava Bhavan State Consumer Disputes Redressal Commission to appeal the verdict, claiming they were unaware of the consumer court lawsuit vying for them and learned about it only after receiving a notification of the verdict.

They continued to state that the waiter’s assertion of attacking the customer was false, and that the customer had only approached the city consumer forum after the incident two years earlier with slanderous intent.

Judges from the state consumer forum noted, however, that a police investigation had been launched in this regard and that a legal notice had been sent to the hotel. Despite all of this, the other party’s ex-parte is unacceptable.
