
The Karnataka High Court has granted anticipatory bail to Aishwarya Gowda, daughter of BJP MLA Suresh Gowda, in a case arising from an alleged altercation with a woman police sub inspector in Mandya district.
The development came after Aishwarya issued a video apology to PSI Savita Patil. The apology followed observations made during an earlier hearing, when the court indicated that her conduct towards the police officer should be addressed before her anticipatory bail request was considered.
The incident dates back to August 12, when Aishwarya had visited the Arathi Ukkada Ahlyadevi temple in Srirangapatna taluk of Mandya district with her children during Bheema Amavasya celebrations. According to the complaint, an argument allegedly took place between Aishwarya and Savita Patil while the PSI was performing security duty at the temple.
The complaint alleged that Aishwarya assaulted the police officer and interfered with her official duty. A case was subsequently registered at Kyathanahalli police station based on the complaint submitted by Savita Patil.
The case includes allegations relating to obstructing a public servant from performing official duties, causing injury, intentional insult and criminal intimidation under provisions of the Bharatiya Nyaya Sanhita.
Aishwarya later approached the Karnataka High Court seeking protection from arrest. During the hearing, the court indicated that an apology to the PSI could be taken into consideration while dealing with the anticipatory bail request.
Following those observations, Aishwarya recorded a video in which she apologised to Savita Patil. Her lawyers later informed the court that the apology had also been reported publicly.
The defence also submitted that Aishwarya and her father had already expressed regret over the incident. Her lawyers argued that the offences alleged in the case carried a maximum punishment of two years and requested that she be granted protection from arrest.
Justice S Vishwajith Shetty heard the matter and subsequently granted Aishwarya anticipatory bail.
Anticipatory bail provides protection from arrest subject to the conditions imposed by the court. It does not amount to a finding that the allegations are proved or that the criminal case has ended.
The dispute began inside the temple premises during the busy festival period. According to the complaint, the disagreement was connected with access to the sanctum. The PSI was reportedly assigned security duties at the temple at the time.
Aishwarya has also made allegations against the police officer and filed a counter complaint. She claimed that the officer had behaved improperly towards her during the incident. These allegations are separate from the original complaint and remain part of the legal proceedings.
The case has attracted attention because it involves the daughter of a sitting BJP MLA and a police officer who was reportedly performing official duties at a religious site.
The courts consideration of the apology has also become an important part of the latest development. Rather than deciding the allegations at the bail stage, the court considered the circumstances surrounding the request for protection from arrest.
The incident itself remains subject to investigation and further legal proceedings. The registration of a case and the allegations made by either side do not by themselves establish criminal liability.
With anticipatory bail now granted, the case will continue according to the applicable legal process. Investigating authorities will examine the complaints, statements and other available evidence before the matter moves forward.
The development also highlights the distinction between bail proceedings and the final determination of a criminal case. Bail decisions concern the question of arrest and related conditions, while the truth of the allegations is ultimately determined through the legal process.
